- "Platform" the Namely website, dashboard, and verification tools.
- "Agreement" this Terms of Service document.
2. Eligibility
To use the Services, you must:
- Be at least 18 years old
- Have the authority to enter into binding agreements
- Use the Services solely for lawful hiring and compliance purposes
- Not misuse or falsify information submitted to the platform
Namely reserves the right to refuse access to anyone for any lawful reason.

Namely provides employers with:

- Reference checks
- ID & right-to-work verification
- Skills assessments
- Behavioural assessments
- Compliance & sanctions screening
- Digital profile generation
- Verification reports
Namely does NOT make hiring decisions. We supply information only. Employers are responsible for their own hiring decisions.

Employers agree to:

Namely only processes candidate information with explicit, recorded consent.
Employers must confirm that:
- The candidate has willingly agreed to verification
- The candidate understands which checks will be conducted
- The candidate knows how their data will be used
Failure to obtain consent is a breach of these Terms.

Namely attempts to deliver accurate and reliable verification results.
However:
- We rely on third-party institutions, employers, and issuers
- Some information may be unavailable or unverifiable
- We cannot guarantee the completeness or accuracy of all data
Namely is not liable for inaccuracies provided by third parties. Employers remain responsible for interpreting verification results.
7. Restrictions on Use
You agree NOT to:
- Use the Services for illegal purposes
- Submit false or misleading information
- Attempt to interfere with platform security
- Reverse-engineer or copy the platform
- Share verification reports publicly or without lawful reason
- Use data for marketing, scoring, or unrelated activities
Violation of these restrictions may result in immediate suspension.
8. Fees & Payments
Where applicable:
- Pricing is listed on the Namely website or Employer Agreement
- Fees must be paid in full and on time
- All fees are non-refundable unless required by law
- Late payments may result in access suspension
Namely may update pricing with prior notice.
9. Service Availability
We strive to maintain uninterrupted access to the platform.
However, we do not guarantee:
- Uninterrupted availability
- Freedom from errors or delays
- Continuous access to all services
Scheduled maintenance, upgrades, or external failures may temporarily affect access.
10. Data Protection & Privacy
Namely processes personal data in compliance with:

- EU GDPR (where applicable)
- Data Protection Act 2018

11. Intellectual Property
All intellectual property on the platform belongs to Namely, including:
- Logos
- Website content
- System architecture
- Verification workflows
- Digital profile designs
- Software code
- Documentation
Employers may use these only as permitted under this Agreement.

Namely may use trusted third parties for:
- Identity verification
- Academic verification
- Employment checks
- Security & hosting
- Data processing
We are not responsible for third-party failures, delays, or inaccuracies.
13. Limitation of Liability
To the maximum extent permitted by law:
- Namely is not liable for hiring decisions made by employers.
- Namely is not liable for errors or omissions from third-party data sources.
- Namely does not indemnify against losses resulting from misuse of verification data.
- Namely's total liability is limited to the amount paid for the service that resulted in the claim.
We do not guarantee outcomes, employment results, or accuracy beyond what is reasonable.
14. Disclaimer of Warranties
The Services are provided "as is", without warranties of any kind.
We do not guarantee:
- Accuracy
- Completeness
- Availability
- Fitness for any particular purpose
Employers use verification data at their own discretion.
15. Termination
We may suspend or terminate access if:
- These Terms are violated
- Laws or regulations require it
- Payment is overdue
- Fraud or misuse is detected
Upon termination:
- Employers must stop using the Services
- Access to reports may be restricted
- Outstanding fees remain payable
16. Governing Law
These Terms are governed by and interpreted in accordance with:
- The laws of England and Wales
- UK data protection laws
Any disputes will be resolved exclusively in UK courts.
17. Changes to the Terms
We may update these Terms occasionally. Changes will be posted on this page with a revised date. Continued use of the platform constitutes acceptance of the updated Terms.
